Terms of Service
These Terms of Service (“Terms”) govern your use of the My Fitness Coach Online website, mobile application, and personalized fitness and nutrition coaching services (“Services”). By using the Services or submitting the coaching questionnaire, you agree to these Terms. If you do not agree, do not use the Services.
Description of services
MFCO provides personalized fitness and nutrition coaching delivered through the MFCO app. Coaching includes program design, guidance, and ongoing support based on the information you provide. Coaching is individual guidance and education, not medical advice, diagnosis, or treatment.
Eligibility and account registration
You must be at least 18 years old to use our Services. You are responsible for providing accurate, complete, and current information in your questionnaire and account, and for maintaining the confidentiality of any account credentials.
Health disclaimer
Consult your physician or qualified healthcare provider before beginning any exercise or nutrition program, especially if you have a medical condition, injury, or are new to exercise. You are responsible for training within your capabilities and following your healthcare provider’s advice. Participation is at your own risk.
Payments, commitments, and cancellations
Coaching is offered in 3, 6, and 12 month terms paid in full with one upfront payment. The total price and term length are confirmed before you complete payment. Coaching terms do not renew automatically. Any cancellation or refund terms will be presented before payment. We do not guarantee specific results, which depend on individual effort, adherence, and other factors.
Your responsibilities
You agree to use the Services lawfully, provide truthful information, follow your program safely, and respect the rights of coaches and other users. You may not misuse the app, attempt to access systems without authorization, or use our content for commercial purposes without permission.
Intellectual property
All content, branding, software, and materials provided through the Services are owned by MFCO or its licensors and are protected by copyright, trademark, and other laws. You may use them only for your personal, non-commercial use as part of your coaching program.
Limitation of liability
To the fullest extent permitted by law, MFCO and its coaches are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Services, including injury, illness, or failure to achieve goals. Our total liability is limited to the amount you paid for Services in the 12 months before the claim.
Indemnification
You agree to indemnify and hold harmless MFCO, its owners, employees, and coaches from claims arising out of your use of the Services, your breach of these Terms, or your violation of any law or third-party right.
Governing law and dispute resolution
These Terms are governed by the laws of the Province of Alberta, Canada, without regard to conflict of laws principles. Any disputes will be resolved in the courts located in Edmonton, Alberta, unless otherwise required by applicable law.
Changes to these terms
We may update these Terms from time to time. The updated Terms will be posted on this page with a revised effective date. Continued use of the Services after changes means you accept the updated Terms.
